مستخلص:إنّ المواد الغذائية المعدّلة وراثيا وحمايتها ببراءات الاختراع من قبل الدول والشركات المتعددة الجنسيات المنتجة لها، من أجل تحقيق أعلى معدلات الكسب، يعد من المخاطر الكبيرة التي تهدد البيئة بصفة عامة وصحة المستهلك بصفة خاصة . بالنظر لما تسببه من أضرار. لذلك یقع على عاتق الدول مسؤولية كبرى من أجل مواجهة هذا الخطر وحمایة مواردها الجینیة وتثمینها الأمر الذي یحتاج إلى إيجاد آليات وقائية، وأخرى ردعية من أجل توفير الحماية القانونية اللازمة للمستهلك بصفة خاصة اتجاه هذا الزحف التكنولوجي . لذلك أردت من خلال هذه المداخلة التطرق إلى الحماية القانونية المسطرة لضمان سلامة وأمن المستهلك من المواد الغذائية المعدّلة وراثيا في ظل الانفجار الاقتصادي، الذي رتّب عنه علاقة غير متكافئة بين مستهلك ضعيف يستلزم توفير الحماية له، في مواجهة عون اقتصادي محترف يسعى لتحقيق الربح على حساب صحة المستهلك والأجيال القادمة.

Genetically modified foods and their protection by patent by the countries and multinationals that produce them, in order to achieve the highest rates of return, constitute a major risk for the environment in general and the health of consumers in particular, given the damage they cause. Therefore, countries bear a great responsibility to face this danger, to protect and valorize their genetic resources, and must find preventive and dissuasive mechanisms to provide the necessary legal protection to the consumer in particular against this technological advance. Therefore, through this intervention, I wanted to address the legal protection needed to ensure the safety and security of the consumer with regard to genetically modified foods in the light of the huge economic expansion, which has led to an unequal relationship between a weak consumer who needs to be assured of safety and an economic operator who seeks to make profits at the expense of the health of consumers and future generations.
