الحماية القانونية للمستهلك من المضافات الغذائية: بين المسموح والمحظور

مستخلص:
إن اقتحام مجال الصناعة الغذائية للمتدخل من أجل تلبية متطلباته المادية، دفعه تجاوز حقوق المستهلكين وانتهاك قاعدة السلامة الغذائية إذ العديد من الامراض مصدرها الغذاء لما يحتويه من مواد سامة أو مسرطنة كما يفتقر من القيمة الغذائية.
فبظهور عدة جوانب سلبية لهذه المضافات الغذائية وكذا كثرة المشاكل الصحية، دفع بالمشرع الجزائري كغيره من المشرعين الاخرين بتسطير الإطار القانوني الخاص بضمان وامن صحة المستهلك قيما يتعلق بالمضافات الغذائية والكميات المسموح بها. خاصة وان المتدخلين في هذه العملية يشهدون تلاعبا كبيرا في الكميات المتعلقة بهذه المضافات على حساب السلامة الجسدية للمستهلك الذي يمثل الطرف الضعيف والمضرور في الحلقة الاقتصادية التي تدور حول الربح المادي بغض النظر عن الجوانب السلبية لها.

Abstract:
The intrusion into the field of the food industry for the interventionist in order to meet his material requirements, prompted him to exceed the rights of consumers and violate the rule of food safety, as many diseases originate from food because it contains toxic or carcinogenic substances and also lacks nutritional value.With the emergence of several negative aspects of these food additives, as well as the large number of health problems, the Algerian legislator, like other legislators, pushed the legal framework for ensuring the consumer’s health and safety, with values related to food additives and the permissible quantities. Especially since those involved in this process are witnessing a major manipulation of the quantities related to these additives at the expense of the physical safety of the consumer, who represents the weak and damaged party in the economic cycle that revolves around material profit, regardless of its negative aspects.
