يعتبر الحق في السلامة الغذائية من أهم الموضوعات التي نالت البحث الوفير، وهذا لارتباطه بحق الإنسان في الحياة، فأصبح بذلك جزءا كبيرا من اهتمام الأفراد والمجتمعات، ونظرا للتطور العلمي الهائل في مجال الصناعة الغذائية، وما صحبه من أخطار مست المادة الغذائية من تلوث وفساد وعدم مطابقة للمعايير، فضلا عن أماكن عرض المنتوجات الغذائية للمستهلك، والتي لا يتوفر البعض منها في كثير من الأحيان على شروط النظافة وكذا النظافة الصحية.
ولأجل كل هذا، وضمانا لحماية قانونية أوفر للمستهلك، تدخل المشرع الجزائري لسن مجموعة قوانين ومراسيم تهدف إلى تنظيم الصناعة الغذائية ونقلها وتحويلها وكيفية بيعها واستهلاكها، ثم رتب جملة من التدابير التحفظية عند حصول مخالفات تمس بجودة وسلامة المنتوج، كما سن جزاءات تختلف باختلاف جسامة المخالفة.

Abstract:
The right to food safety is one of the most important topics that has received abundant research, and this is because it is related to the human right to life, thus becoming a large part of the interest of individuals and societies, and given the tremendous scientific development in the field of the food industry, and the accompanying dangers of contamination, corruption and non-conformity with food. standards, as well as places to display food products to the consumer, some of which often do not meet the conditions of hygiene as well as hygiene.
For all this, and in order to ensure more legal protection for the consumer, the Algerian legislator intervened to enact a set of laws and decrees aimed at regulating the food industry, its transportation and transformation, and how it is sold and consumed, then arranged a number of precautionary measures when violations occur that affect the quality and safety of the product, as well as enacting penalties that vary according to the severity of the violation.
