مستخلص:تُعدّ اللغة القانونية أداةً أساسيةً في صياغة التشريعات وإصدار الأحكام القضائية، إذ تعتمد الأنظمة القانونية على نصوصٍ مكتوبةٍ بعنايةٍ لتحقيق العدالة وضمان استقرار العلاقات بين الأفراد والدولة. وتتميز هذه اللغة بخصائص دقيقةٍ تهدف إلى تجنب الالتباس وسوء الفهم. إلا أن الطبيعة التقنية والمعقدة للمصطلحات القانونية قد تؤدي أحيانًا إلى غموضٍ أو تداخلٍ في المعاني، مما يستدعي اللجوء إلى التفسير لضمان تطبيق النصوص تطبيقًا صحيحًا.
تكمن أهمية البحث في أن عدم وضوح بعض النصوص القانونية أو اختلاف تفسيرها قد يؤدي إلى تباينٍ في التفسير القضائي، مما يُهدد استقرار الأحكام ويؤثر على تحقيق العدالة. ومن هنا، تبرز الحاجة إلى تفسير النصوص القانونية وفق ضوابط محددة تضمن الاتساق بين النصوص المختلفة وتحد من التأويل غير المنضبط.
يهدف هذا البحث إلى تحليل اللغة القانونية من حيث بنيتها وخصائصها، مع التركيز على دراسة ضوابط التفسير القانوني لضمان الوصول إلى المعنى الصحيح للنصوص وتطبيقه عمليا، كما يسعى إلى مقارنة أساليب التفسير بين النظم القانونية العربية والغربية، لتقديم رؤية متكاملة حول كيفية التعامل الفعال مع النصوص القانونية.
كما تتناول الدراسة حلولاً عملية للتغلب على تحديات الغموض اللغوي، مثل تطوير أدوات متخصصة في التفسير القانوني، وتدريب القضاة والمحامين على قواعد التفسير. ويأمل البحث من خلال هذا التحليل أن يُسهم في تحقيق الاستقرار القضائي الذي يعزز العدالة والثقة في النظام القانوني.

ABSTRACT:
Legal language is an essential tool in drafting legislation and issuing judicial rulings, as legal systems rely on carefully written texts to achieve justice and ensure stability in relations between individuals and the state, This language has subtle characteristics that aim to avoid confusion and misunderstanding, However, the technical and complex nature of legal terms may sometimes lead to ambiguity or overlapping meanings, which requires resorting to interpretation to ensure that the texts are applied correctly correct.
The importance of the research lies in the fact that the lack of clarity of some legal texts or the difference in their interpretation may lead to a discrepancy in judicial interpretation, which threatens the stability of rulings and affects the achievement of justice, Hence, there is a need to interpret legal texts according to specific controls that ensure consistency between different texts and limit uncontrolled interpretation.
This research aims to analyze the legal language in terms of its structure and characteristics, with a focus on studying the controls of legal interpretation to ensure the correct meaning of the texts is achieved and applied in affair, It also seeks to compare the methods of interpretation between Arab and Western legal systems, to provide an integrated vision on how to deal with legal texts effectively.
The study also addresses practical solutions to overcome the challenges of linguistic ambiguity, such as developing specialized legal interpretation tools and training judges and lawyers on the rules of interpretation, through this analysis, the research hopes to contribute to achieving judicial stability that enhances justice and confidence in the legal system.
