مستخلص:
تُعدّ الحماية الاجتماعية أحد الركائز الأساسية لضمان الاستقرار الاجتماعي والاقتصادي، إذ تهدف إلى توفير شبكة أمان للأفراد والفئات الأكثر هشاشة في المجتمع. وقد ازدادت أهميتها في ظل التحديات الاقتصادية والاجتماعية المتصاعدة التي تواجهها العديد من الدول، مما يستدعي وضع أطر قانونية فعّالة تنظم آليات الحماية الاجتماعية وتكفل تحقيق العدالة والتنمية المستدامة.
يتناول هذا البحث الأطر القانونية التي تحكم الحماية الاجتماعية، ويقيّم مدى فعاليتها في تحقيق الأهداف المنشودة، كما يستعرض التحديات التي تواجهها، ويقدّم مقترحات لتطويرها. وعلى الرغم من تعدد التشريعات والبرامج المعنية بالحماية الاجتماعية، إلا أن هناك فجوات كبيرة في التطبيق تعيق تحقيق العدالة الاجتماعية والتنمية المستدامة.
وتتمحور إشكالية البحث حول السؤال الرئيس التالي: ما مدى مساهمة الأطر القانونية للحماية الاجتماعية في تحقيق العدالة الشاملة والتنمية المستدامة؟
تنبع أهمية هذا البحث من الحاجة الملحة لتحليل الأطر القانونية التي تنظم الحماية الاجتماعية، والكشف عن أوجه القصور في تطبيقها، واقتراح سبل لتطويرها بما يعزز العدالة الاجتماعية ويحقق أهداف التنمية المستدامة. كما يُسهم البحث في إثراء النقاش الأكاديمي حول العلاقة بين الحماية الاجتماعية والتشريع القانوني، ومدى تكاملهما مع السياسات العامة للدولة.
ويهدف البحث إلى: (1) تحليل مفهوم الحماية الاجتماعية وأهدافها وأهميتها في تعزيز الاستقرار الاجتماعي؛ (2) دراسة الأطر القانونية الوطنية والدولية؛ و(3) تقييم دور برامج الحماية الاجتماعية في تحقيق العدالة والتنمية المستدامة.
يعتمد البحث على المنهج الوصفي التحليلي من خلال دراسة الأطر القانونية والتشريعية المنظمة للحماية الاجتماعية. ويسعى إلى تقديم رؤية شاملة للعلاقة بين التشريع والتطبيق في مجال الحماية الاجتماعية، مع التأكيد على ضرورة الإصلاح القانوني لضمان تحقيق العدالة والتنمية المستدامة بفعالية وكفاءة أكبر.

Abstract: Social protection constitutes a fundamental pillar for ensuring social and economic stability, as it aims to establish a safety net for individuals and the most vulnerable groups in society. Its significance has grown in light of the increasing economic and social challenges facing many countries, which necessitates the establishment of effective legal frameworks to regulate social protection mechanisms and guarantee justice and sustainable development.
This research explores the legal frameworks governing social protection, assessing their effectiveness in achieving intended goals and identifying the challenges they encounter. It also proposes recommendations for enhancing these frameworks. Despite the existence of various legislations and programs dedicated to social protection, significant gaps in implementation persist, hindering the realization of social justice and sustainable development.
The central research question is: To what extent do legal frameworks for social protection contribute to achieving comprehensive justice and sustainable development?
The importance of this study lies in the urgent need to critically examine the legal systems regulating social protection, identify shortcomings in their application, and propose reforms that strengthen social justice and align with sustainable development objectives. The research also contributes to the academic discourse on the interplay between social protection and legal regulation, and their alignment with broader public policy.
The study aims to: (1) analyze the concept, objectives, and significance of social protection in promoting social stability; (2) examine national and international legal frameworks; and (3) evaluate the role of social protection programs in achieving justice and sustainable development.
Employing a descriptive-analytical approach, the study investigates the legal and legislative structures underpinning social protection. It seeks to offer a comprehensive perspective on the relationship between legislation and its practical application, highlighting the imperative of legal reform to ensure more efficient and effective outcomes in justice and development.
