يمثل الإطار القانوني الدولي لحماية البيانات وحرية التعبير عبر الحدود في عصر الإعلام الرقمي تحديًا كبيرًا في ظل التحولات التقنية السريعة وانتشار وسائل الإعلام الرقمية وتأثيرها العالمي. وتتمثل الإشكالية الرئيسية لهذه الورقة البحثية في كيفية تحقيق التوازن بين حماية البيانات الشخصية وضمان حرية التعبير، مع مراعاة الخصوصيات الثقافية والقانونية لكل دولة ضمن البيئة الرقمية العالمية.
وتكمن أهمية الموضوع في كونه يمس حقوق الإنسان الأساسية ويؤثر في المجتمعات والأفراد، مما يجعل تطوير إطار قانوني دولي شامل ضرورة ملحة لضمان حماية الحقوق في عصر الإعلام الرقمي. وتهدف الدراسة إلى تحليل الأطر القانونية القائمة، وتحديد أوجه القصور فيها، واقتراح حلول لتطوير التشريعات بما يحقق التوازن بين حماية البيانات وحرية التعبير عبر الحدود.
اعتمد البحث على منهج تحليلي مقارن لدراسة القوانين الوطنية والدولية ذات الصلة وتحليل فعاليتها. وتضمنت بنية البحث مقدمة توضح الإطار العام للموضوع، ثم تم تقسيمه إلى ثلاثة مطالب:
المطلب الأول: المفهوم الدولي لحرية العمل الإعلامي وحدود الحق في التعبير.
المطلب الثاني: التوازن بين حماية البيانات وحق الإعلام في الحصول على المعلومات ونشرها.
المطلب الثالث: التوازن بين حماية البيانات الشخصية وحق الوصول الإعلامي.
وتوصل البحث إلى عدة نتائج أبرزها وجود تفاوت كبير بين التشريعات الوطنية، وعدم توافق بعضها مع المعايير الدولية، وأوصى بضرورة صياغة اتفاقية دولية موحدة تعزز التعاون بين الدول، وتقر مبادئ واضحة لحماية البيانات وحرية التعبير بما يراعي التحولات الرقمية ويحقق العدالة بين جميع الأطراف.

Abstract:
The international legal framework for data protection and freedom of expression across borders in the age of digital media represents a major challenge in light of the rapid technical transformations and the spread of digital media and its global impact. The main problem of this research paper is how to achieve a balance between the protection of personal data and the guarantee of freedom of expression, taking into account the cultural and legal specificities of each country in the global digital environment.
The importance of the topic is reflected in the fact that it affects fundamental human rights and affects societies and individuals, making the development of a comprehensive international legal framework an urgent necessity to ensure the protection of rights in the age of digital media. The research aims to analyze existing legal frameworks, identify gaps, and propose solutions to develop legislation to achieve a balance between data protection and freedom of expression across borders. The research relied on a comparative analytical approach to study relevant national and international laws and analyze their effectiveness.
The research structure included an introduction clarifying the general framework of the topic, and it was divided into three demands. The first demand is the international concept of freedom of media work and the limits of the right of expression. The second demand is a balance between data protection and the right of the media to obtain and disseminate information. The third demand is a balance between the protection of personal data and the right to media access. The research reached several results, most notably the existence of great disparities between national legislations, and the incompatibility of some of them with international standards, and recommended the need to draft a unified international convention that enhances cooperation between countries, and stipulates clear principles for data protection and freedom of expression in a manner that takes into account digital transformations and achieves justice between all parties.
