مستخلص:

تناولت هذه الدراسة القصاص بين الأصول والفروع، دراسة فقهية، فقمت بتعريف مفردات العنوان، القصاص والأصول والفروع لغة واصطلاحاً، وبيان مشروعيته في القرآن الكريم والسنة النبوية المطهرة، وتحدثت عن أنواع القصاص في الشرع الحنيف، وبينت حُكم قتل الأصل بالفرع من عدمه والعكس لدى الفقهاء، وتطرقت للقصاص بين الأصول والفروع فيما دون النفس، وذكرت حكم اشتراك الأجنبي مع الأصل في الاعتداء على فرعه في النفس ودونها، والعكس، وذلك من خلال بيان أقوال الفقهاء في ذلك بين مجيز ومانع، ومناقشتها والترجيح فيها.

Abstract:

This study dealt with retaliation between the ancestors and the descendants in a jurisprudential study. I defined the terms of the title retaliation, the origins and the branches in language and terminology. I explained its legitimacy in the Holy Quran and the Sunnah of the Prophet. I talked about the types and explained the necessity of killing the origin for the branch or not and vice versa according to the jurists.

I also touched on retaliation between the origins and the descendants in what is less than the soul, and I mentioned the ruling on the foreigner sharing with the origin in harming his branch in the soul and its color, and vice versa, by explaining the opinions of the jurists on this between those who permit and those who prohibit, and discussing and weighing them.
