مستخلص:تعتبر المياه مورد طاقوي استراتيجي مهم جدا لاستمرار دورة الحياة ، لذلك فمسؤولية المحافظة عليها وترشيد استخدامها هو التزام على كل فرد في هذا العالم وعلى كل الدول والحكومات على غرار الجزائر التي كرست الحماية القانونية للموارد القانونية في كافة فروع القانون العام والخاص، ونلمس أهمية هذا الموضوع في ارتباطه بالأمن المائي الوطني، وفي كونه يمس صميم الحق في التنمية والعيش الكريم، كما يمثل مدخلًا لفهم مدى قدرة التشريعات على مجابهة التحديات البيئية والمجتمعية المعاصرة، فسنحاول من خلال هذه الورقة البحثية تسليط الضوء على مرتكزات السياسة الوطنية للمياه في الجزائر، ودور الضبطية القضائية ذوو الإختصاص النوعي في مجال حماية المياه ، وكذا العقوبات المقررة في حال الاعتداء على الموارد المائية وحالات موانع قيام المسؤولية الجزائية.

Water is a strategic energy resource that is very important for the continuity of the life cycle. Therefore, the responsibility to preserve it and rationalize its use is an obligation for every individual in this world and for all countries and governments, such as Algeria, which has dedicated legal protection to legal resources in all branches of public and private law. The importance of this topic lies in its connection to national water security and in the fact that it touches on the core of the right to development and a decent life. It also represents an entry point for understanding the extent of the ability of legislation to confront contemporary environmental and societal challenges. Through this research paper, we will attempt to shed light on the foundations of the national water policy in Algeria, the role of judicial police with specific jurisdiction in the field of water protection, as well as the penalties stipulated in the event of an attack on water resources and cases that prevent the establishment of criminal liability.
