ملخص: يعتبر استقرار القوانين ووضوحها وثباتها من أهم آليات جلب الاستثمار الأجنبي، وتستمد القوانين المطبقة على الاستثمار أهميتها من كونها بمثابة الضمانات التي يسعى المستثمر الأجنبي للحصول عليها في الدول المضيفة لاستثماره خصوصا النامية منها، نظرا لما يحققه له من حماية وأمان، ويمكنه من تحقيق أهدافه وفق ما خطط له. وفي هذا الإطار فقد نهجت سلطنة عمان منذ عهد السلطان الراحل قابوس بن سعيد، إصلاحات قانونية وتشريعية مختلفة من أجل توفير بيئة أعمال مريحة خالية من المخاطر وقادرة على استقطاب رؤوس الأموال الأجنبية، جسدها جلالة السلطان هيثم بن طارق مباشرة بعد توليه الحكم في أول خطاب له، ليؤكد استراتيجية السلطنة نحو تعزيز الترسانة القانونية من حيث الاستقرار والوضوح والثبات كرافد للاستثمار الأجنبي. وعليه تتمحور إشكالية الدراسة حول تبيان “ما مدى كفاية البيئة القانونية في سلطنة عمان لخلق مناخ جاذب للاستثمار الأجنبي المباشر؟ وما هي آفاق تعزيز الترسانة القانونية واستقرارها ووضوحها وثباتها لزيادة ثقة المستثمرين الأجانب؟ وذلك من خلال تحليل توجه السلطنة نحو وضع البيئة التشريعية الملائمة لجلب الاستثمارات الأجنبية الضخمة، خاصة في ظل التحول الاقتصادي العالمي والذي يسير في اتجاه استغلال الاستثمارات الأجنبية الكبرى بهدف تعزيز تنافسية الاقتصاد الوطني وفق رؤية عمان 2040. وعليه، نقترح أن تكون دراستنا مقسمة إلى محورين رئيسين، وذلك على النحو التالي: المبحث الأول: مظاهر استقرار قوانين الاستثمار ووضوحها وثباتها في سلطنة عمان المبحث الثاني: استراتيجية سلطنة عمان في تعزيز البيئة التشريعية الضامنة لجلب الاستثمارات الأجنبية.Summary:
The stability, clarity and consistency of laws is considered one of the most important tools to attract the foreign investment. The importance of investment laws comes from the guarantees the foreign investor endeavors to meet in the hosting countries specially the developing once, since this will guarantee the protection and safety to him, as well as enable him to achieve his goals accordingly.
In this context, The Sultanate of Oman has pursed, since the late Sultan Qaboos bin Saeed, different legal and legislative reforms in order to provide a convenient work environment that is hazard free and able to attract foreign capital. Immediately this approach was confirmed by H M Sultan Haitham bin Tariq in his first speech after he assumed power, ensuring the Sultanate strategy towards reinforcing the legal concrete by stability, clarity and consistency of laws as the tributary of foreign investment.
Purposefully, the researcher proposes the research questions of the study to explain:
Accordingly, the problem of the study revolves around clarifying: what extend the legal investment is sufficient to create attractive chances for direct foreign investment? what are the enhancing prospects of the legal concrete and its stability, clarity and consistency of laws as the tributary of foreign investment to improve it confidence?
Therefore, the researcher will analyze the Sultanate orientation to establish the suitable legislative environment to attract the huge foreign investments, in light of the global economic transformation, which moves towards utilizing the huge foreign investment in order to boost the local economy contest according to Oman vision 2040.
Thus, the researcher puts this section into two main sub-sections as follows:
1- Stability, clarity and consistency of laws aspects in The Sultanate of Oman.
2- The strategy of The Sultanate of Oman to reinforce the guarantee legislative environment to attract foreign investment.
