تناول هذا البحث موضوع المقاولة من الباطن في القانون العماني، في ضوء الانتشار الواسع لأعمال المقاولة وتعدد تخصصاتها، وما يترتب على ذلك من صعوبة تنفيذ المشروع من قبل المقاول الأصلي بمفرده. وينطلق البحث من إشكالية غياب تنظيم قانوني مفصّل لعقد المقاولة من الباطن في قانون المعاملات المدنية العماني، رغم أهميته المتزايدة سواء في العقود الخاصة أو الإدارية. ويهدف إلى بيان أثر هذا العقد على التزامات طرفي عقد المقاولة الأصلي، من خلال منهج وصفي وتحليلي يستند إلى النصوص القانونية والأحكام القضائية المتاحة. ويخلص إلى نتائج أبرزها جواز المقاولة من الباطن بشروط محددة، وتأثيرها المباشر وغير المباشر على أطراف العقد، مع توصية المشرع العماني بضرورة تنظيم أحكامها بشكل أكثر تفصيلًا.

This research dealt with the subject of subcontracting in Omani law, in light of the wide spread of contracting works and the multiplicity of its specializations, and the consequent difficulty of implementing the project by the original contractor alone. The research stems from the problem of the absence of a detailed legal regulation of the subcontracting contract in the Omani Civil Transactions Law, despite its increasing importance, whether in private or administrative contracts. It aims to demonstrate the impact of this contract on the obligations of the parties to the original contracting contract, through a descriptive and analytical approach based on available legal texts and judicial rulings. It concludes with conclusions, most notably the permissibility of subcontracting under specific conditions, and its direct and indirect impact on the parties to the contract, with the recommendation of the Omani legislator to regulate its provisions in more detail.
