مستخلص:برغم المساهمة الفاعلة لقطاع التعليم الأولي الخاص في العراق في تحقيق متطلبات التعليم الجيد كهدف من أهداف التنمية المستدامة، إلا انه يواجه معوقات جمة تُقَيَّد نشاطه، وتَحد من قدرته على العطاء والتطور، وتُحَجَّم دوره في رفد العملية التربوية والارتقاء بها لما هو أفضل. وتقف وراء هذه الإشكالية عدة أسباب يتصدرها عدم تشريع قانون خاص بالتعليم الأولي الأهلي. لذا جاء في مقدمة ما انتهت إليه توصيات هذه الدراسة: حث المشرَّع العراقي على الإسراع بالاستجابة لما قضى به الدستور النافذ بتجسيد كفالة التعليم الخاص وتحصينه من خلال سَّن قانون ينظم وجوده وكينونته وبما يتيح لهذا القطاع الحيوي الإسهام بقوة وكفاءة في البرنامج الحكومي للتنمية المستدامة.

Despite the effective contribution of the private primary education sector in Iraq to achieving the requirements of quality education as a goal of sustainable development, it faces many obstacles that restrict its activity, limit its ability to give and develop, and limit its role in supporting the educational process and upgrading it for the better. Behind this problem are several reasons, foremost among them the failure to legislate a law on private primary education. Therefore, the recommendations of this study were as follows: Urging the Iraqi legislator to expedite the response to the provisions of the Constitution in force by embodying the guarantee of private education and fortifying it through the enactment of a law regulating its existence and entity in a way that allows this vital sector to contribute strongly and efficiently to the government program for sustainable development.
