مستخلص:تعتبر الأصناف النباتية الجديدة إحدى آليات تحقيق الأمن الغذائي والصحة العامة وتحقيق التنمية المستدامة فهي مصدر أساسي للصناعة الغذائية .كما أنها شكل من أشكال الملكية الفكرية التي تستحق الحماية القانونية الجدية والفعالة والكاملة. غير أن الحماية القانونية الجزائرية شابتها الكثير من الثغرات والنقائص حالت دون تحقيق الغاية من وضعها وهو ما احتوته المداخلة المعنونة : أهمية الأصناف النباتية الجديدة في الصناعة الغذائية – أي فعالية للحماية القانونية المقررة لها؟ والتي أظهرنا من خلالها أهمية الصنف النباتي الجديد في تدعيم الصناعة الغذائية ومدى فاعلية القانون المؤطر لها في توفير حماية جدية لهذا المحصل الزراعي.

New plant varieties are one of the mechanisms for achieving food security and public health and achieving sustainable development, as they are an essential source for the food industry. It is also a form of intellectual property that deserves serious, effective and full legal protection. However, the Algerian legal protection was tainted by many gaps and deficiencies that prevented the achievement of the purpose of its development, which was contained in the intervention entitled: “The importance of new plant varieties in the food industry – What is the effectiveness of the legal protection provided for them?” through which we showed the importance of the new plant variety in strengthening the new food industry and the effectiveness of the law framing it in providing serious protection for this agricultural crop.
