مستخلص:إن استعمال المضافات الغذائية في مختلف المنتوجات الغذائية والأطعمة أصبح ضرورة عملية وتجارية، وانتشر بشكل واسع رغبة من المتدخلين بتحسين منتوجاتهم لزيادة الإقبال عليها، وقد أجازت المادة 8 من قانون حماية المستهلك وقمع الغش للمنتج إمكانية إدماج المضافات الغذائية في المواد الغذائية وذلك وفق الشروط والمعايير المرخص بها، غير أن الاستعمال غير المضبوط لهذه المضافات قد يشكل خطرا على صحة وسلامة المستهلك، الأمر الذي دفع المشرع الجزائري إلى إصدار نصوص قانونية تضبط عملية استعمالها ضمانا لسلامة المنتوج وحماية لصحة المستهلك، معتمدا في ذلك النظام الدولي المتعلق بالمضافات الغذائية، غير أن عدم تنفيذ المتدخل للأطر القانونية المسطرة في هذا المجال، يترتب عليه قيام المسؤولية الجزائية، من خلال تجريم كل فعل من شأنه الإخلال بالأحكام المنظمة لاستعمال المضافات الغذائية، وهو الأمر الذي نحاول توضيحه من خلال هذه الورقة البحثية.

The use of food additives in various food products and foods has become a practical and commercial necessity, there has been a widespread desire of interventionists to improve their products to increase demand for them. Article 8 of the Consumer Protection and Suppression of Fraud Act has authorized the product to integrate food additives into food in accordance with licensed conditions and standards.
However, uncontrolled use of these additives may pose a threat to the health and safety of the consumer, which prompted the Algerian legislator to issue legal texts that control the process of using them to ensure product safety and protect consumer health, based on the international system related to food additives. However, the failure of the interventionist to implement the legal frameworks in this area entails criminal liability, by criminalizing any act that would violate the provisions governing the use of food additives, which we are trying to clarify through this research paper.
