مفهوم التعليم كحقٍّ من حقوق الإنسان الأساسيَّة

تهدف الدراسة إلى تقديم فكرة الحقِّ في التعليم؛ كونَه من الحقوق التي سعى المجتمع الدولي على التأكيد عليها، سواءٌ على الساحة الدوليَّة أو الداخليَّة. كما تناولت الدراسة الخصائص التي يتميَّز بها هذا الحُّق؛ وذلك بالتزامن مع تطبيقه بجعله مُتاحًا لأفراد المجتمع الواحد بدون تمييز، ومتوافرًا في كافَّة مراحله، ويحظى بالقبول مِن قبل أفراد المجتمع الواحد وضمن الظروف المختلفة.

كما قدَّمت الدراسة المواثيق الدوليَّة: كالإعلان العالمي لحقوق الانسان، والعهد الدولي الخاصّ بالحقوق الاقتصاديَّة والاجتماعيَّة، مرورًا بتقديم حقِّ التعليم وَفْقًا للميثاق الأوروبي لحقوق الانسان، وختامًا مع الميثاق العربي لحقوق الانسان لعام 2004، حيث ذكر الحقّ في التعليم فيها وبتوجُّهاتٍ مختلفة.

وخلُصت الدراسة إلى أنَّ الحقَّ في التعليم من الحقوق الأساسيَّة التي ترافق الإنسان وتعتمدها مختلف الدول، وقد أكَّد عليها المجتمع الدولي في العديد من الاتِّفاقيَّات والمواثيق التي لاقتْ القبولَ لدى الكثير من الدول، والتي سعت هي بدورها لاعتمادها في أنظمتها الداخليَّة.

Abstract:

This study aims to present the concept of the right to education as one of the fundamental rights that the international community has sought to affirm and promote, both at the international and domestic levels. The study examined the essential characteristics of this right, focusing on ensuring its availability to all members of society without discrimination, providing it at all stages, and ensuring its acceptability and adaptability to different social and cultural circumstances.

The study reviewed the most prominent international instruments that emphasized the right to education, starting with the Universal Declaration of Human Rights and the International Covenant on Economic, Social and Cultural Rights, followed by the articulation of this right in the European Convention on Human Rights, and concluding with the Arab Charter on Human Rights of 2004, where the right was highlighted with varying approaches.

The study concluded that the right to education is a fundamental right that accompanies individuals throughout their lives and has been adopted by many countries in their domestic legal systems based on their international obligations. International instruments have also emphasized the importance of this right as a tool for achieving equality and promoting sustainable development.
