مستخلص:لعبت الوساطة دورا حاسما في الحضارات عبر التاريخ، حيث كانت بمثابة وسيلة لتعزيز الحوار والعدالة وحل المنازعات بين الأفراد والجماعات. وقد أكد هذا النهج على احترام وجهات النظر والمواقف المختلفة، يسعى في نهاية المطاف إلى حل المنازعات بطريقة سلمية ومتفق عليها من قبل الطرفين. مع تطور المجتمعات البشرية، تطور أيضا مفهوم الوساطة، وباتت مبادئ الحق والمسؤولية والمساءلة أساسية في عملية الوساطة. وقد أدى هذا التطور إلى تطوير أشكال وبدائل مختلفة لعدم اللجوء الى التقاضي التقليدي الكلاسيكي.
في جوهرها، أصبحت الوساطة أداة متطورة ودقيقة لحل المنازعات، ويعكس هذا التطور تحولا أوسع نطاقا نحو فهم أكثر شمولا لحل الصراعات، لذلك لعبت المبادرة التلقائية خاصة في المغرب باعتبارها آلية مؤسسية، دورا أساسيا في معالجة المنازعات، ويسمح هذا السلوك الاستباقي بالتفكير العاجل والقدرة على التفاوض في إيجاد حلول مع الأطراف المتنازعة لحل المنازعات وتحقيق العدالة. هي مبادرة تسمح بتحريك مسطرة النظر في التصرفات الصادرة عن الإدارة المخالفة للقانون أو المنافية لمبدأ العدل والإنصاف، وإجراء الأبحاث والتحريات اللازمة بشكل تلقائي مع تقديم المقترحات والتوصيات بشأن ذلك.
تأسيسا عليه، عززت الدولة المغربية ترسانتها القانونية لتعزيز مكانة الوساطة المؤسساتية، من أجل حلول منصفة وعادلة للتصدي لكل التعسفات السلوكية للإدارة التي يمكنها أن تلغي حقا مشروعا أو تجحف في ممارسته، وقد عكس هذا الوضع، البحث في سبل تطوير آلياتها وتضمينها في دستور المملكة لسنة 2011 والتزام الدولة باحترام المواثيق والاتفاقيات الدولية.

Abstract :
Mediation has played a crucial role in civilizations throughout history, as it served as a means to promote dialogue, justice and resolve disputes between individuals and groups. This approach emphasized respect for different viewpoints and positions, ultimately seeking to resolve disputes in a peaceful and mutually agreed upon manner.
As human societies evolved, the concept of mediation also evolved, and the principles of right, responsibility and accountability became fundamental to the mediation process, which led to the development of different forms and alternatives to not resorting to traditional classical litigation.
In essence, mediation has become a sophisticated and precise tool for resolving disputes, and this evolution reflects a broader shift towards a more comprehensive understanding of conflict resolution, so spontaneous initiative, especially in Morocco as an institutional mechanism, played a fundamental role in addressing disputes, and this proactive behaviour allows for quick thinking and the ability to negotiate solutions with the disputing parties to resolve disputes and achieve justice.
It is an initiative that allows the procedure of examining actions issued by the administration that are contrary to the law or the principle of justice and fairness to be activated, and the necessary research and investigations to be conducted automatically, with the submission of proposals and recommendations in this regard. Based on this, the Moroccan state has strengthened its legal arsenal to enhance the status of institutional mediation, for fair and just solutions to address all the behavioural abuses of the administration that could cancel a legitimate right or be unfair in its exercise. This situation has reflected the search for ways to develop its mechanisms and include them in the Moroccan Constitution of 2011 and the state’s commitment to respect international charters and agreements.
