ملخص:
تشكل المخطوطات من أهم المصادر التي تعكس لنا حياة المجتمع في جميع المجالات السياسية والاجتماعية والاقتصادية والثقافية والفنية. ويأتي على رأس تلك المخطوطات سجلات المحاكم الشرعية للجزائر العاصمة بمذاهبها الثلاثة المالكية والحنفية والإباضية. وهي ثلاثة أنواع سجلات لمختلف العقود، وسجلات مراسلات القضاة مع الإدارة الفرنسية ومع قضاة محاكم مدينة الجزائر ومدن جزائرية أخرى، وسجلات ترتيب العقود.
وتعتبر سجلات المحاكم الشرعية المرجعية الأساسية لتاريخ المجتمع الجزائري والتي تعكس مدى مساهمة القضاة في تقييد كل المعاملات بين الأفراد وكذا الزواج والطلاق والبيوع…، ومن هنا اكتست أهميتها لدى الكثير من الباحثين في الكشف عن تاريخ المجتمع الجزائري الذي حاولت الإدارة الفرنسية طمس الكثير من معالمه الحضارية العربية.

Abstract:
Manuscripts are one of the most important sources that reflect society’s lives in all political, social, economic, cultural and artistic spheres. At the top of these manuscripts are the records of Algiers’ sharia courts in their three Maliki, Hanafi and Ibadi doctrines. These are three types of records of various contracts, records of the judges’ correspondence with the French administration and with the judges of the courts of Algiers and other Algerian cities, and records of the arrangement of contracts.
The records of the Shari ‘a courts are the basic reference for the history of Algerian society and reflect the extent to which judges contribute to restricting all transactions between individuals, marriage, divorce and sale… hence their importance is demonstrated by many researchers in revealing the history of Algerian society, which the French administration has tried to obliterate many of its Arab cultural features.
