ملخـص:
بادر المغرب إلى المصادقة والانضمام لأغلب الاتفاقيات الدولية لحقوق الإنسان، إدراكا منه بأهمية هذه المنظومة. وانعكس ذلك على الالتزام الطوعي بمقتضيات القانون الدولي لحقوق الإنسان، وقد توج هذا المسار باعتماد دستور 2011 الذي يعد بمثابة ميثاق للحقوق والحريات.
وإذا كانت حقوق الإنسان في الحالات العادية لا يفترض أن تخضع لأي تقييد من طرف الدول، فإن التساؤل يثار في حالات الطوارئ الصحية الناتج عن انتشار كوفيد 19، وما رافقها من تدابير مقيدة لعدد من الحقوق والحريات. وترتب عن هذا الوضع منازعات قضائية حول شرعية هذه الإجراءات باعتبار القضاء حامي الحقوق والحريات. لذلك، فإن الإشكالية المطروحة تتعلق بكيفية تفاعل القضاء المغربي مع هذه المنازعات ومدى قدرته على حماية حقوق الإنسان في ظل الظروف الاستثنائية الصحية.
وقد تم التوصل في هذه الدراسة إلى أن القضاء المغربي تفاعل مع إعلان السلطات لحالة الطوارئ الصحية وتقييد بعض الحقوق، ولم يتوقف كليا عن ممارسة رسالته القضائية، رغم اختلاف وتأرجح موقفه من محكمة لأخرى بين الإقرار الكلي لممارسة حق من الحقوق، والتحفظ عن ممارسة حقوق أخرى.

ABSTRACT
Morocco has taken the initiative to ratify and accede to most international human rights conventions, recognizing the importance of this system. This was reflected in the voluntary adherence to the requirements of international human rights law. This path has been culminated in the adoption of the 2011 Constitution, which is considered as a charter of rights and liberties.
If human rights are not supposed to be subject to any restriction by States in ordinary cases, the question about the restrictive measures on a number of rights and freedoms arises during health emergencies resulting from the spread of Covid 19. This situation has resulted in legal disputes about the legitimacy of these procedures considering judicial system the protector of rights and liberties. The problematic at hand therefore relates to how the Moroccan judiciary system interacts with these conflicts and the extant of its ability to protect human rights under the exceptional health conditions.
The study concluded that the Moroccan judiciary system had interacted with the authorities’ declaration of a state of health emergency and the restriction of certain rights. It had not completely ceased to exercise its judicial mission, although its position from court to court differed and fluctuated between the full recognition of the exercise of a certain right and the reservation from the exercise of other rights.
